1. Acceptance of Terms

By accessing our website, making a booking, or participating in a Party Kartz tour, you agree to be bound by these Terms and Conditions, our Privacy Policy, our Refund Policy, and the Liability Waiver. If you do not agree to these terms, please do not use our services.

2. Eligibility Requirements

• Age Requirement: All participants must be at least 21 years of age. Valid government-issued photo ID is required at the time of the tour.
• Waiver Requirement: All participants must sign a liability waiver before participating in any tour.
• Physical Condition: Participants must be in suitable physical condition to safely participate in the tour. If you have any health concerns, please consult with your physician before booking.

3. Booking and Payment

• All bookings are subject to availability.
• Full payment is required at the time of booking.
• A 3.99% convenience fee applies to all online transactions.
• We accept major credit cards and debit cards.
• Prices are subject to change without notice, but confirmed bookings will be honored at the quoted price.

4. Tour Policies

Hours of Operation

Party Kartz operates daily from 11:00 AM to 11:00 PM. Tour times are scheduled within these hours.

Tour Duration

Standard tours are 1 hour and 45 minutes. Please arrive 15 minutes before your scheduled tour time.

Late Arrivals

If you arrive late, your tour time may be shortened to accommodate subsequent bookings. No refunds will be provided for shortened tours due to late arrival.

Group Size

Each kart can accommodate up to 6 guests. For larger groups, please contact us about tandem tours with both karts.

5. BYOB (Bring Your Own Beverage) Policy

Party Kartz allows guests to bring their own beverages under the following conditions:

• All participants consuming alcohol must be 21 years of age or older.
• No glass containers - All beverages must be in plastic or aluminum containers.
• No hard liquor (spirits) - Only beer, wine, seltzers, and similar beverages are permitted.
• Party Kartz reserves the right to refuse service to anyone who appears intoxicated.
• Guests are responsible for the safe and legal consumption of any alcoholic beverages.
• Party Kartz is not responsible for any consequences resulting from alcohol consumption.

6. Rules of Conduct

All guests must adhere to the following rules during their Party Kartz experience:

• Remain seated at all times while the vehicle is in motion.
• Follow all instructions given by the Party Kartz driver/guide.
• No illegal substances or activities.
• Treat the vehicle, equipment, and staff with respect.
• No harassment of other guests, staff, or members of the public.
• Wear appropriate clothing and footwear.
• No hanging off or outside the vehicle.
• Keep all body parts inside the vehicle at all times.

Violation of these rules may result in immediate termination of the tour without refund and the application of the $300 Early Termination Fee.

8. Liability and Assumption of Risk

Participation in a Party Kartz tour involves inherent risks, including but not limited to:

• Operation of a motorized vehicle
• Weather conditions
• Road conditions
• Interaction with other vehicles and pedestrians
• Physical demands of the activity

By participating in a Party Kartz tour, you acknowledge these risks and voluntarily assume full responsibility for any injury or damage that may occur. A full liability waiver must be signed before participation.

9. Photo and Video Release

By participating in a Party Kartz tour, you grant Party Kartz LLC permission to use any photographs or video recordings taken during your tour for promotional purposes, including but not limited to: social media, website, advertising materials, and marketing campaigns. You understand you will not receive compensation for such use.

10. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Party Kartz LLC and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Party Kartz LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of our services.

12. Indemnification

You agree to indemnify and hold harmless Party Kartz LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services or violation of these Terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Pinellas County, Florida.

14. Changes to Terms

Party Kartz LLC reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
