1. AGE VERIFICATION
I certify that I am at least 21 years of age. I understand that all participants and guests must be 21 years or older
to participate in any Party Kartz experience. A valid government-issued photo ID is required at the time of the tour
and must be presented upon request.
2. ASSUMPTION OF RISK
I acknowledge that participating in a Party Kartz tour involves inherent risks, including but not limited to:
operation of a motorized vehicle, weather conditions, road conditions, other vehicles or pedestrians, and my own
physical condition. I voluntarily assume all risks associated with participation in this activity.
3. RELEASE OF LIABILITY
In consideration of being permitted to participate in the Party Kartz experience, I hereby release, waive, discharge,
and covenant not to sue Clearwater Beach Cruisers LLC, its owners, officers, employees, agents, and representatives from any and all
liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury,
including death, that may be sustained by me, or to any property belonging to me, while participating in such activity,
regardless of whether such loss is caused by the negligence of Clearwater Beach Cruisers LLC or otherwise.
4. BYOB (BRING YOUR OWN BEVERAGE) POLICY
I understand that Party Kartz allows guests to bring their own beverages under the following conditions:
- All participants consuming alcohol must be 21 years of age or older
- No glass containers are permitted - all beverages must be in plastic or aluminum containers
- No hard liquor (spirits) is allowed - only beer, wine, seltzers, and similar beverages
- Party Kartz reserves the right to refuse service to anyone who appears intoxicated
- I am responsible for the safe and legal consumption of any alcoholic beverages
5. RULES OF CONDUCT
I agree to abide by the following rules during my Party Kartz experience:
- Remain seated at all times while the vehicle is in motion
- Follow all instructions given by the Party Kartz driver/guide
- No illegal substances or activities
- Treat the vehicle, equipment, and staff with respect
- No harassment of other guests, staff, or members of the public
- Wear appropriate clothing and footwear
6. FEE SCHEDULE
I acknowledge and agree to the following fee schedule:
- Early Termination Fee: $300 - If the tour is terminated early due to behavior violations,
including but not limited to: intoxication affecting safety, failure to follow driver instructions, harassment,
or any dangerous behavior, a $300 fee will be charged.
- Abandonment Fee: $100 - If any guest chooses to leave the tour early or separates from
the group without prior arrangement, a $100 fee will be charged per occurrence.
- Damage Fees - Any damage to the vehicle, equipment, or property caused by guests will
be charged at actual repair/replacement cost.
7. PHOTO/VIDEO RELEASE
I grant Clearwater Beach Cruisers LLC permission to use any photographs or video recordings taken during my tour for promotional
purposes, including but not limited to: social media, website, advertising materials, and marketing campaigns.
I understand I will not receive compensation for such use.
8. INDEMNIFICATION
I agree to indemnify and hold harmless Clearwater Beach Cruisers LLC from any loss, liability, damage, or cost that may incur
due to my participation in this activity, whether caused by my negligence or otherwise.
9. ACKNOWLEDGMENT
I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up
substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily,
and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
